By accessing or using our website (moizwp.com), purchasing software licenses (such as Moiz Subscriptions Pro or Moiz Booking Pro), or commissioning custom web development, MERN stack engineering, Shopify solutions, or automation services, you agree to be bound by these Terms of Use and all applicable laws and regulations.

If you do not agree with any part of these terms, you must refrain from using our website and digital services.

2. Scope of Engineering & Digital Services

MoizWP provides custom digital solutions, including:

• Full-stack website development, custom themes, and headless web applications (React, Next.js, Node.js, MERN).
• Shopify storefront design, app integrations, and checkout customisations.
• Proprietary WordPress plugin licensing, updates, and documentation.
• Self-hosted n8n automation pipelines, AI agent workflows, and CRM setup.
• Speed optimization, Core Web Vitals remediation, and Generative Engine Optimization (GEO).

All project deliverables, timelines, and technical requirements are specified in individual project scope proposals or milestone agreements prior to project commencement.

3. Payment Terms, Escrow Protection & Refund Policy

To ensure 100% financial safety and transparency:

• Fiverr Escrow Billing: Clients may hire MoizWP via our official Fiverr Escrow Partner link. Payments are held in escrow by Fiverr and released only upon client approval of completed milestone deliverables.
• Direct Global Payments: Direct payments are accepted via Payoneer (Customer ID: 26570613) according to the payment schedule detailed in your formal statement of work (SOW).
• Refunds: Milestone payments released upon client review are non-refundable. If a project is cancelled prior to milestone completion, unreleased escrow funds remain protected under the payment provider's dispute resolution policies.

4. Intellectual Property & Ownership Rights

Upon final payment for custom project work:

• Client Deliverables: You own the custom graphics, text, branding assets, and bespoke application code created specifically for your organization as defined in the project scope.
• Proprietary Code & Plugin Frameworks: MoizWP retains ownership of pre-existing core frameworks, open-source libraries, reusable starter kits, and proprietary plugin source code (such as Moiz Subscriptions Pro). Clients receive a non-exclusive, non-transferable license to operate such plugin software as specified in their purchase plan.

5. Client Responsibilities

To guarantee timely project completion, clients agree to:

• Provide necessary brand assets, copywriting, credentials, and API access required for execution in a timely manner.
• Review project milestones and provide feedback within agreed evaluation windows.
• Ensure that all materials supplied to MoizWP do not infringe upon third-party copyrights or trademarks.

6. Warranties & Bug Fix Guarantees

All custom web development projects include a post-launch warranty period (as specified in your proposal, typically 30 to 90 days) covering bug fixes and technical support for features built within original scope.

Except as expressly stated, our website, software templates, and materials are provided "as is" without warranty of any kind, express or implied.

7. Limitation of Liability

In no event shall MoizWP, Imran Javed, or its affiliates be liable for any indirect, incidental, consequential, special, or punitive damages (including loss of profits, data loss, business interruption, or third-party hosting outages) arising out of or in connection with the use or inability to use our services or deliverables.

8. Support & Ticket System Guidelines

Client support, technical inquiries, and bug reporting must be routed through our official Support Ticket system at moizwp.com/create-ticket or directly via official project communication channels to ensure logged accountability and timely resolution.

9. Changes to Terms

We reserve the right to revise these Terms of Use at any time. Modified terms will become effective immediately upon posting to this page. Your continued use of our website or services following any updates signifies your acceptance of the revised terms.
